Maintenance/Alimony commonly refers to a court ordered obligation to support a spouse following, and sometimes during divorce proceedings.  Maintenance is currently governed by the Illinois Marriage and Dissolution Act.  A spouse may be ordered to pay their spouse temporary or permanent maintenance based upon a variety of facts, including, disparity in income, income earning capacity, contribution to the marital household, length of the marriage and the standard of living during the marriage.  Maintenance is more common in divorces involving spouse with large incomes or property.
